General terms and conditions

In these terms and conditions, we make clear agreements about what you purchase from ToetsJeKennis.nl, how long it is valid, how payment and cancellation work, and what you can expect from us.

1. Who we are

2. Definitions

• We / ToetsJeKennis.nl: Rope Media B.V., trading under the name ToetsJeKennis.nl.
• You / customer: any person or organisation that has an account or purchases something from us.
• Training course: a package of lessons, tests, practice exams, exam questions, explanations and/or study materials on a topic, as described on the page for that course.
• Subscription: access to one or more training courses for a period of one month, which is continuously renewed automatically by one month.
• One-off purchase: a training course you pay for once, with access for 180 days and without automatic renewal.
• Certificate: proof in your name that you have completed the course and passed the final exam. The certificate is issued directly by ToetsJeKennis.nl.
• AI credits: credit in your account used to access the platform's AI features, such as asking questions to the AI tutor or generating an extra practice test.
• Account: your personal environment on our exam platform, where you take your training courses.

3. What you buy

• All our lessons, tests, practice exams, exam questions, explanations and study materials are created by us. Exactly what a training course includes is stated on the page for that course.
• Every product clearly states whether it is a subscription or a one-off purchase. You will also see this during checkout. Training courses for an exam are usually purchased as a subscription; a course with a certificate is a one-off purchase.
• You receive digital access to the course in your account. You will not receive any physical products.
• Training courses for an official exam prepare you for it. You sit that exam with the relevant examination board. We cannot guarantee that you will pass.
• For a course with a certificate, you conclude with our own final exam. If you pass, you can download your certificate in your account. The certificate shows that you have completed the course. It is not a government or official examination board diploma.
• We keep our courses up to date and are entitled to improve or adjust them, for example in response to new exam requirements or legislation. The core of what you have purchased remains unchanged.

4. Subscription: duration and renewal

• A subscription runs on a monthly basis. It starts the moment your first payment has been received.
• The subscription is automatically renewed each month for another month, until you cancel. With the first payment, you authorise us to automatically deduct the subscription fee each month via your chosen payment method.
• We do not send an email, notification or invoice upon renewal. You can always view your subscription and the next payment date in your account.
• With each paid renewal, your access continues for another month.
• If an automatic payment fails, for instance due to insufficient funds, your access ends at the conclusion of the last paid period.

5. Cancelling your subscription

• You can cancel your subscription yourself in your account at any time, with no notice period. You will immediately see until when your access remains active.
• After cancelling, no further payments will be debited. You keep access until the end of the month you have already paid for.
• No refunds are provided for a month you have already paid for upon cancellation (except when exercising your right of withdrawal; see article 9).
• If you cannot cancel in your account, please contact us and we will cancel it for you.

6. One-off purchase: access and validity

• With a one-off purchase, you pay once. Nothing is automatically renewed or debited, and you do not need to cancel anything.
• You have access for 180 days, starting from the moment your payment has been received. Within that period, you can study at your own pace and pick up where you left off.
• Once your access period expires, you can no longer open the course. If you want to continue, you can purchase the course again.
• If you do not pass the final exam, you can retake it at no extra cost and as many times as needed while your access is active.
• An earned certificate remains stored in your account even after your access expires, so you can always view and download it. The course itself can no longer be opened or retaken after that.

7. AI credits

• At the start of your subscription, you receive 100 AI credits. With each paid renewal, you receive another 100.
• With a one-off purchase, you receive 100 AI credits once, the first time you use an AI feature.
• If you need more, you can buy extra AI credits in bundles within your account. You can view the bundles and prices in your account. Extra purchased credits are paid for once. There is no subscription attached to them.
• Each AI feature costs a certain number of credits. You can see how many in the platform before you use the feature. Reporting an error in a question does not cost any credits.
• AI credits carry over, including after a renewal, and do not expire. They are personal and tied to your account. You cannot transfer them or exchange them for cash.
• You use AI credits within the training courses you have access to. If your access ends, your credits remain in your account for whenever you regain access later.
• AI credits are not covered by the right of withdrawal and are non-refundable. This applies to both used and unused credits, including any extra credits you have purchased.
• The AI tutor is a study aid. We do our best to ensure the answers are correct, but the AI can make mistakes. In case of doubt, our own exam questions, explanations, and official sources always take precedence.

8. Prices and payment

• All prices are in euros and are final prices. Our training courses are exempt from VAT, so no VAT is added.
• You pay in advance at checkout via our payment provider Mollie (for example, with iDEAL or credit card). You get access as soon as your payment has been received.
• We reserve the right to adjust our prices. A new price will not apply to a period you have already paid for. If we increase the price of your current subscription, we will notify you at least 30 days in advance, and you can cancel before the new price takes effect.
• If you reverse a payment (chargeback) without a valid reason, we will block your access to the relevant course. The amount remains due, as do any costs we incur as a result of the chargeback, within the limits of the law.
• If you order as a business (using a company name), you cannot reverse a payment for a delivered service.
• If we approve a refund request, we will refund the amount within 14 days using the same payment method.

9. Right of withdrawal (cooling-off period)

• If you buy as a consumer, you have a 14-day cooling-off period. Within that period, you can cancel the agreement without giving any reason via the contact form, provided you have not yet used the course.
• Once you have completed a practice exam, your right to a cooling-off period expires. Our training courses are digital and immediately accessible. When ordering, you therefore explicitly agree to receive immediate access and that your cooling-off period expires as soon as you take a practice exam.
• No cooling-off period applies to AI credits. They are not covered by the right of withdrawal and are non-refundable (see article 7).
• If you withdraw within the cooling-off period and have not yet used the course, we will refund the full amount within 14 days.

10. Your account

• Your account is personal. You must keep your login details confidential and not grant others access to your account. You are responsible for everything that happens via your account, until you report to us that someone else is misusing it.
• The details you provide to us must be accurate and complete. You can read how we handle your data in our privacy policy.
• If an organisation purchases access for employees, each access grant applies to one individual employee.
• You use a free practice exam with a free account. No rights can be derived from this.

11. Using our content

• All our exam questions and study materials are created by us. We register them with an i-DEPOT at the Benelux Office for Intellectual Property. The copyright and all other intellectual property rights in the website, the platform, and the content remain with us.
• You may only use the courses to prepare yourself for your exam. Copying, sharing, reselling, publishing, automated scraping, or using our content to train AI models is not permitted without our written consent. You can find more information about this in our Intellectual property policy.
• In the event of misuse, we may immediately block your access and terminate the agreement, without any refund. In addition, we may recover any damages we suffer as a result of the misuse. If it concerns misuse by a business, that business will also be liable for an immediately payable penalty of €10,000 per day that the misuse continues.

12. Availability

• We do our best to keep the platform available at all times and to resolve outages quickly. We cannot guarantee that the platform will never be unavailable, for example due to maintenance or third-party disruptions.
• If an outage not caused by you lasts longer than 5 consecutive working days, you will receive a proportionate refund for the period you did not have access.

13. Liability

• Our liability is limited to direct damages, up to a maximum of the amount you paid for the relevant training course in the 12 months prior to the damage.
• We are not liable for indirect damages, such as consequential loss, lost profits, or failing an exam.
• These limitations do not apply in cases of intent or gross negligence on our part, nor to the extent that the law does not permit any limitation.
• Please report any damage as soon as possible after discovering it.

14. Force majeure

• In the event of force majeure (a situation beyond our control, such as internet, telecoms or power disruptions, or government measures), we are not liable and our obligations will be suspended.
• If the force majeure lasts longer than 30 days, either of us may terminate the agreement. You will receive a proportionate refund for any period for which you have paid but did not have access.

15. Complaints

• Do you have a complaint? Please let us know via the contact form with a clear description. We respond within 2 working days.
• We aim to resolve your complaint within 2 weeks. If we need more time, we will let you know within 2 working days.
• We handle your complaint confidentially and retain complaints for a maximum of 1 year.
• If we cannot reach an agreement together, the complaint can be submitted to Lexys Advocaten, Haringvliet 88, 3011 TG Rotterdam, as an independent third party. We abide by their ruling and will act upon the consequences within 4 weeks. You always retain the right to go to court.

16. Amendments and other provisions

• We may amend these terms and conditions. An amendment will take effect no earlier than 14 days after we have announced it. If you do not agree with an amendment, you can cancel your subscription before the amendment comes into effect. For a one-off purchase you have already made, the terms that applied at the time of your purchase will continue to apply, unless an amendment is in your favour.
• If any provision of these terms and conditions is invalid, the remaining provisions will continue in full force and effect.
• You may not transfer your account, subscription, or rights under this agreement to anyone else without our written consent.
• These terms and conditions and every agreement with us are governed by Dutch law. Any disputes will be submitted to the competent court in Rotterdam, unless the law designates another court.
